Britain’s New Data Law Is Reshaping How Students Use AI

As the Data (Use and Access) Act 2025 rolls out, British universities are entering a new phase of the artificial intelligence era, one in which widespread student reliance on generative tools collides with stricter rules on automated decision-making, privacy safeguards and accountability, reshaping not whether students use A.I., but how cautiously and consciously they do so

For most British undergraduates, generative artificial intelligence has become less a novelty than a fixture of academic life. Surveys show that 92 percent of students use generative A.I. tools in some form, and 88 percent have relied on them for assessments, up sharply from 53 percent in 2024.

But as the Data (Use and Access) Act 2025, known as DUAA, moves toward full implementation, the culture surrounding that use is beginning to change. What was once a largely unregulated wave of experimentation is giving way to a more cautious and self-aware approach. Increasingly, students are not only asking what A.I. can produce, but how it works, how their data is handled and what recourse they have if something goes wrong.

The shift has been swift. Within a single academic year, generative A.I. tools moved from optional aids to near-essential academic infrastructure. Nearly half of incoming undergraduates now arrive at university already accustomed to using A.I. tools in secondary school. Time savings remain a powerful incentive, with 51 percent of students citing efficiency as a primary reason for use. Yet legislative change is introducing a new layer of scrutiny.

DUAA received Royal Assent in June 2025 and signals a more structured approach to data governance and automated decision-making in Britain. Among its provisions are safeguards around significant decisions made solely by automated systems. While the law creates what it describes as a “more permissive framework” for such decisions, it also requires that individuals be informed, allowed to challenge outcomes and given access to human intervention.

These provisions matter because A.I. systems are increasingly woven into educational processes, from grading support tools and adaptive learning platforms to risk flags and recommendation engines. Students are beginning to ask practical questions: If an algorithm influences my academic record, what are my rights, and who is accountable?

“For students, trust and safety show up in everyday routines, from learning platforms to the services they rely on when moving to a new city,” said Devendra Saini, Director of Organic Growth at Amberstudent.com. “As AI becomes embedded, students are thinking carefully about their data footprint. This check-first mindset reflects a wider demand: tools must support studies without compromising privacy or fairness.”

The law also includes protections for children by design, requiring certain online services likely to be accessed by minors to consider protective measures in their design. Implementation will occur in stages between two and twelve months after Royal Assent, with the Information Commissioner’s Office phasing in changes between June 2025 and June 2026. The government has also committed in Parliament to asking the regulator to produce codes of practice on educational technology and artificial intelligence.

Even as students embrace A.I., universities are struggling to keep pace. Eighty percent of students say their institution has an A.I. policy, yet only 29 percent report that their university actively encourages the use of such tools. Seventy-six percent believe their institution can detect A.I. use, and 53 percent cite fear of being accused of cheating as their primary deterrent.

At the same time, 51 percent of students say they worry about false results or hallucinations produced by A.I., and 18 percent report including A.I.-generated text directly in their work. Among younger users, 42.8 percent say they routinely check A.I. outputs because they could be wrong.

Faculty members broadly support critical engagement with the technology. A recent literacy report found that 86.2 percent of teachers believe students should be taught to engage critically with generative A.I. Yet only 30.8 percent of teachers have received formal training from their school or college, and 66.9 percent say they need more support to use the tools effectively.

This mismatch has created a paradox. Students are adopting A.I. at scale, while institutions are still debating boundaries and building expertise. The result is a generation that uses the technology extensively but with growing caution. The habit of checking outputs, questioning sources and considering privacy implications is becoming part of academic literacy.

The government has signaled that it favors responsible adoption over prohibition. At the U.K. Generative AI for Education Summit held in January 2026, updated product safety expectations were discussed, reinforcing the emphasis on safeguards rather than bans.

As Britain moves deeper into 2026, the question is no longer whether students will use artificial intelligence. The data suggests they will. The emerging question is whether a framework built around privacy by design and rights to challenge automated decisions can foster trust without slowing the educational gains many students say they value.

Students are unlikely to abandon the tools that help them research, draft and organize their work. But they are increasingly unwilling to use them blindly. Instead, they are looking behind the interface, asking who built the system, how it handles their data and what protections exist when the machine makes a mistake.
